CENTRAL COMBAT SPORTS

All membership fees are non-negotiable and non-refundable. All fees are to be paid in full. Memberships require an eight (8) month minimum commitment, specifically seventeen (17) bi-weekly payments of $65.00 plus HST. Any membership cancellation thereafter must be made in writing and will take effect after five (5) business days. This agreement is for an Adult membership provided by Central Combat Sports Inc., located at 1565 Lauzon Road, Unit #2, Windsor, Ontario, N8S3N4, Canada.

Memberships and recurring payments cannot be temporarily paused or suspended for any reason until the minimum commitment is fulfilled, except in the event of a government mandated lockdown or if Central Combat Sports Inc. is unable to provide services for a period longer than 14 days. Any declined payments will incur a penalty fee of $10.00 plus the balance owing. After one (1) insufficient payment, you or your child will be prohibited from attending classes until any outstanding balance is paid in full, and an alternative, reliable payment method is established. Failure to pay the agreed upon membership fees may result in your file being sent to a collections agency. In the event of any dispute arising from a member’s failure to pay membership dues or any other money due to Central Combat Sports Inc., the prevailing party shall be entitled to recover all actual attorneys’ fees and costs incurred in connection therewith.

In some cases, this membership agreement may be terminated before the agreed upon minimum payment duration for a fee of $150.00+HST, but will be determined on a case by case basis and at the sole discretion of Central Combat Sports Inc.

Central Combat Sports Inc. reserves the right to terminate the membership of any individual at its sole discretion. Central Combat Sports Inc. may immediately terminate the membership of any individual that attempts to circumvent the rules of Central Combat Sports Inc. or is involved in harmful behavior towards the members, guests or property of Central Combat Sports Inc. Any individual that causes damage to the equipment or property of Central Combat Sports Inc., whether intentionally, unintentionally or through negligent behaviour, will be responsible for all replacement costs for damaged items. Central Combat Sports Inc. may collect these costs from any bank account or credit card associated with the individual responsible for the damages at its sole discretion and without notice.

By entering into this agreement, you are authorizing Central Combat Sports Inc. to begin collecting membership payments as per this agreement for recurring payments and/or one-time payments from time to time, and for payment of all charges arising under your membership with Central Combat Sports Inc., from your specified bank account or credit card. You must also agree to immediately provide an alternative payment method should your credit card or bank account prove to be unreliable for any reason.

Adult members must complete a 10 day probationary period before receiving an access key to the facility. Adult members under the age of 18 will be eligible for an access key on a case by case basis. All members and guests must agree to abide by any facility rules or policies, and to follow any general or safety guidelines made available by Central Combat Sports Inc. Failure to follow any rules or guidelines may result in the temporary or permanent revocation of your access key for the duration of your membership. Our programs offered, class schedule, and hours of availability are subject to change without notice, and may change from time to time.

Short-term visitors to the region, or visitors from out of town, are not eligible for membership, including the advertised 10 day satisfaction guarantee. A private lesson or short-term training pass must be purchased instead to attend classes for the duration of your visit, if available at that particular time.

If you are not satisfied with your membership, you have 10 days upon signing this agreement to cancel your membership without penalty. Your initial payment however will not be refunded upon your cancellation, and you will no longer be able to attend classes or enter the facility immediately thereafter. By signing this agreement, you attest that you are not relying upon any oral or written representations or statements made by any directors, officers, employees, sub-contractors or representatives of Central Combat Sport Inc. other than what is set forth in this agreement.

I am aware that there is potential risk for injury involved in the training and participation of any physical activity, especially martial arts. I freely accept and fully assume all such risks, dangers and hazards, including but not limited to injury through physical activity and/or use of equipment and facilities, and the possibility of personal injury, death, the contraction of communicable disease such as viruses, bacteria, fungi or protists, or property damages or loss, resulting from my participation in any or all services provided by or endorsed by Central Combat Sports Inc. I am also aware that I should discuss my or my child’s participation in this activity with a physician to determine the effect on my or my child’s current health. I also acknowledge and accept that my image or my child’s image may be used for advertising purposes.

Release of liability, waiver of claims and indemnity agreement: in consideration to participate in the activities of Central Combat Sports Inc., I hereby agree as follows:

To waive any and all claim that I have or may in the future have against Central Combat Sports Inc., its directors, officers, employees and representatives, officials, club executives, guests and players or participants (all of whom are hereinafter collectively referred to as “Releasees”).

To release the releasees from any and all liability for any loss, damage, disease, injury or expense that I may suffer or that my next of kin may suffer as a result of my participation in any service provided by or associated with Central Combat Sports Inc. Due to any cause whatsoever, including negligence, breach of contract or breach of any statutory or other duty of care. I acknowledge my responsibility to ensure adequate medical personal health, dental and accident insurance coverage, as well as protection of my personal possessions.

To hold harmless and indemnify the releasees from any and all liability for any damage to property of, or personal injury to, or costs, any third party, resulting from my participation in this activity.

This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns or representatives in the event of my death or incapacity.

In entering into this agreement, I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this agreement.
